Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Propelo iOS app and the Propelo website (collectively, the “Service”), operated by Firecode Labs, LLC (“Firecode Labs,” “we,” “our,” or “us”). By accessing or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Use of the Service

1.1 Eligibility

You must be at least 13 years old and legally capable of entering into binding contracts. You may use the Service only in compliance with these Terms and all applicable laws and regulations.

1.2 Personal Use Only

The Service is intended for personal, non-commercial use unless otherwise agreed upon in writing by Firecode Labs.

1.3 Account Registration

Access to the Propelo app requires signing in with a Google account or Apple ID. Google account connection is required to access core functionality. If you sign in with Apple, you will also need to connect a Google account to use the Service.

2. Privacy and Data Handling

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, store, process, and share information and describes your privacy rights. By using the Service, you acknowledge the data practices described in the Privacy Policy. Where applicable law requires consent for a particular type of processing, we will request that consent separately.

3. User Content

3.1 Your Tasks and Data

You retain ownership of the tasks and other content you create through the Service. You grant Firecode Labs a limited license to store, process, and transmit that content as necessary to provide the Service, including calendar integration and AI-generated Actions. This license includes allowing our service providers to process the content solely on our behalf.

3.2 AI-Generated Actions

When a task becomes your top task and does not already have an Action, the Service automatically sends its task text to the OpenAI API to generate an Action. Task text is not sent before the task becomes your top task or if the task already has an Action. Details about the information sent to OpenAI are provided in our Privacy Policy.

AI-generated Actions may be inaccurate, incomplete, inappropriate, or unsuitable for your circumstances. You should review each generated Action before relying on or acting upon it. AI-generated Actions do not constitute medical, legal, financial, or other professional advice. You remain responsible for how you use generated Actions and for any decisions or activities based on them.

AI-generated Actions may not be unique, and the Service may generate identical or similar content for other users.

3.3 Prohibited Use

You agree not to use the Service to:

• Violate laws or infringe on third-party rights
• Attempt to reverse-engineer, copy, or modify the Service
• Transmit viruses or malicious content
• Interfere with the functionality or security of the Service

4. Intellectual Property

All content, code, features, and branding associated with Propelo and the website are the property of Firecode Labs and are protected by copyright, trademark, and other laws. You may not reproduce or use them without our express written permission.

5. Third-Party Services

The Service integrates with third-party platforms such as:

• Google and Google Cloud Platform (for login, calendar syncing, hosting, and database services)
• OpenAI (for generating an Action from eligible task text when a task becomes your top task)
• Mixpanel and Google Analytics (for pseudonymous usage analytics, which may be anonymized or disabled by the user)
• Apple Inc. (Sign in with Apple authentication)
• Mailchimp (Intuit) — marketing emails for opted-in users
• Postmark (for transactional email delivery)
• Cloudflare (for network performance and security)

Your use of these features is also subject to the respective third-party terms and privacy policies. Firecode Labs is not responsible for any third-party service interruptions or data issues outside our control.

We may update or change integrations at any time. Continued use of the Service following changes in third-party services indicates acknowledgment of such changes.

5.1 Service Availability

Certain features of the Service rely on third-party services, including Google Calendar. Firecode Labs does not guarantee the availability, accuracy, or uninterrupted operation of third-party services. Functionality such as calendar syncing may be delayed, limited, or unavailable due to third-party outages, rate limits, or changes outside our control.

6. Payments and Subscriptions

Certain features of the Service require a paid subscription. All payments, billing, renewals, and refunds are processed and managed by Apple through the App Store. Firecode Labs does not process or store payment information. Subscription management, cancellations, and refund requests must be handled through your Apple ID account settings, in accordance with Apple’s policies.

Firecode Labs has no ability to issue refunds or modify subscriptions on Apple’s behalf.

7. Termination

We reserve the right to suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may delete your account at any time through the app or by contacting us at contact@firecodelabs.com.

When you delete your account, your user account and profile-linked product data are deleted from active service use, and session tokens are cleared from your device. We retain certain records where reasonably necessary for billing integrity, subscription verification, fraud and security prevention, accounting, auditability, legal compliance, and the establishment, exercise, or defense of legal claims. These records may include de-linked Apple subscription records, Apple server notification event logs, optional account deletion feedback, infrastructure and application logs, and pseudonymous identifiers used to reconcile related subscription and financial records. Anonymous analytics records may also remain. We restrict retained records to the purposes described above and retain them only for as long as reasonably necessary or legally required. 8. Disclaimer of Warranties

The Service, including AI-generated Actions, is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any AI-generated Action will be accurate, complete, reliable, unique, or suitable for a particular purpose.

9. Limitation of Liability

To the fullest extent permitted by law, Firecode Labs shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service, including but not limited to data loss or unauthorized access.

10. Changes to These Terms

We may update these Terms at any time. If the changes are significant, we will notify you via email or through the app. Your continued use of the Service after changes indicates acknowledgment of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law principles. Any disputes shall be resolved in accordance with applicable law in that jurisdiction.
